1. Introduction
This page sets out the terms and conditions on which we supply the goods listed on our website store.tinkerlog.com. Please read these terms and conditions carefully before ordering any goods from the Tinker Store. You should understand that by ordering any of our goods, you agree to be bound by these terms and conditions.
The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering goods in case there are any changes.
2. Our Contract
All orders are subject to acceptance by us and availability. After placing an order, you will receive an email from us acknowledging that we have received you order. It will state the items you have ordered, the cost (including VAT where applicable and postage and packaging) and delivery details. Please note that this acknowledgment email does not mean that your order has been accepted - your order constitutes an offer to us to purchase the items. All orders are subject to acceptance by us and we will confirm such acceptance by sending you an email confirming that we have dispatched the items to you. That email (the Dispatch Confirmation) shall represent our legal acceptance of the offer you made to purchase the items.
3. Price and Payment
We aim to ensure that the pricing of goods and services on the web pages is correct at all times. However, the web pages may not always accurately reflect the correct details at the moment at which you place your order. We reserve the right to change prices without prior notice at any time prior to dispatch. We cannot confirm the price of a good or service until your order is accepted via the Dispatch Confirmation.
Our selling prices are gross prices and include applicable value added tax. Shipping and packaging costs are added separately. Goods dispatched by the Tinker Store to addresses outside of the European Union are generally not subject to VAT.
If you order outside of Germany prices may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict this amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
4. Return and Refunds
Your statutory rights as a consumer are not affected if, for any reason, you wish to return any goods bought in the Tinker Store. By law, customers in the European Union have the right to withdraw from the purchase of an item within 14 days of the day after the date the item is delivered without giving a reason. When returning goods from a consignment where the total value of the order does not exceed 40.00 Euro, the customer shall bear the costs of returning the goods. Otherwise the customer shall not be obliged to pay for the return of the goods.
5. Warranty
We warranty all equipment to be free from material defects in workmanship or materials for a period of 2 years from date of shipment. If at any time within 2 years after shipment the equipment does not function as warranted, return it and we will repair or replace it without charge. You pay shipping costs to return the equipment to us.
If any product is subject to federal or state consumer warranty laws, our statement of limited warranty included with the product applies in place of these warranties. Misuse, accident, modification, unsuitable physical or operating environment, improper maintenance by you or failure caused by an item for which we are not responsible may void these warranties. This warranty replaces any other warranty, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
6. Limitation of Liability
If we default, or because of other liability you are entitled to recover damages from us, then regardless of the basis on which you are entitled to claim damages we are only liable for the amount of any actual loss or damage up to the charges for the product or service that is the subject of the claim. Under no circumstances are we liable for third-party claims against you for losses or damages; loss of or damage to your records or data; or consequential damages (including lost profits or savings) or incidental damages, even if we have been advised of the possibility of such damages.
7. Applicable Law
This Agreement and any order issued hereunder shall be governed by German law.
